The various contemporary uses of information and communication technologies depict a setting of asymmetry of powers between ordinary users and the controlling owners of these tools, such as apps, platforms and social networks, threatening the guarantee of fundamental rights on the Internet such as freedom of expression, privacy and the protection of personal data.
The defence of digital rights requires that regulatory mechanisms of the virtual environment be democratic and participatory in order to remove not only the technovigilance of States, but also of the so-called "Internet Giants" (Google, Apple, Facebook, Amazon and Microsoft), whose business models are based on observation and control of human experience and behaviour. These concerns have crossed the legislative debate on the Copyright in the Digital Single Market Directive (CDSM), adopted under the pretext of optimising and updating the protection of the rights of creators and artists on intellectual works on the Internet.
However, during this period of transposition to European countries, questions are being raised as to whether platform liability provisions for such content would not open up scope for private censorship and user monitoring. In this sense, this Workshop aims to discuss aspects of the Directive that reach and deal with users' rights as the free uses of intellectual creations with the innovations on limitations and exceptions to copyright and the use of protected works for educational purposes, in addition to their cross-border effects for the Global South.
