Study on working conditions, professional burnout, health and well-being of Portuguese judges

Abstract

The general objective is to evaluate the working conditions, professional exhaustion (burnout), health and well-being of the judges exercising functions in the judicial and administrative and tax courts, in the different instances, in Portugal.
The study has the following specific objectives:

a) socio-legal characterization of Portuguese judges, duly contextualized in their Statute and in the organization and functioning of the judicial system;

b) assessment of the working conditions of judges exercising functions in Portuguese courts;

c) presentation of a set of programmatic recommendations, regarding the statute of judicial magistrates, working conditions, professional burnout, health and personal well-being.

To meet these objectives, qualitative and quantitative methodologies will be applied:

(i) content analysis of legislation and documents relating to the statutory legal framework of the profession, as well as the legal framework relating to the structure and functioning of the judicial system Portuguese and the characterization of the courts, from which the sample of the courts where interviews will be carried out will be defined;

(ii) bibliographic collection and analysis, namely regarding public policies, statistical analysis related to the sociographic characterization of judicial magistrates;

(iii) conducting exploratory and semi-structured interviews, discussion panels and application of a questionnaire survey.


This study is carried out within the scope of the agreement signed between the OPJ/CES and the Association of Portuguese Judges, High Council of Judges, Supreme Court of Justice, Court of Appeal of Coimbra, Court of Appeal of Évora, Court of Appeal of Guimarães, Court of Appeal of Lisbon and Court of Appeal of Porto.
