About
Directive (EU) 2019/1023 of the European Parliament and of the Council of 20 June 2019 intended to provide national legal systems with more efficient regimes for the preventive restructuring of viable companies and entrepreneurs.
Portugal and Spain promoted the transposition of the Directive, through Law n.º 9/2022, of January 11, and Law 16/2022, of September 5, respectively, diplomas that introduced changes in judicial procedures de reestructuración de deuda l: el proceso especial de revitalización (PER), in the Portuguese case, and the plan of reestructuración, in spanish.
In a framework of recognised economic interdependence and legal affinities between the two countries, convergent solutions and dissonant options are observed in those transposition acts, which open up spaces for debate and critical reflection.
The University of Salamanca, through the Proyecto Alerta de Insolvencia y Derecho de Sociedades (AIDS), and the Permanent Observatory of Justice of the Centre for Social Studies of the University of Coimbra come together to organise a day of discussion dedicated to the recent modifications introduced in the Luso-Spanish insolvencies law in the field of company recovery. The event will feature speakers from the academic world and the legal practice from Portugal and Spain who will address some of the most significant aspects of the national legal systems in the field of company recovery, including the cross-border aspect.
