Crazy and criminal women and the Public Defender Office in the zone of non-being

Overview

The proposal of this Slam Seminar is fundamentally inter and transdisciplinary, because it is placed on the dialogue between legal knowledge and psychiatric knowledge, whose marriage, in the scope of criminology, produced the legal figure of security measures (“medidas de segurança”) to be fulfilled by whom is found non-criminally liable in judicial asylums . It it follows from the doctoral research on human rights at UFRJ and it matches at a time when Portugal is once again discussing the separation of the common crazy and the crazy criminals, as is clear from the article "Ten years of delay in regime for interning prisoners with mental illness ", available online, on March 17th.

The proposed debate intends to present some data gathered in the fieldwork, in which the researcher and the Public Defender are confused in a single body, and it intends to establish a dialogue on the ethical implications in the research with the manicomalized women. Is it possible, for the researcher, to create bridges between knowledge, in the sense of producing fissures in the justice system, from the emerging concerns of the subversive and emancipatory use of law by the defender?

The women imprisoned in the judicial asylums of Rio de Janeiro are living witnesses / survivors of the interpenetration of captivity (“cautiverios” de Lagarde) in the zone of non-being (Fanon). Thus, the seminar slam intends to debate when structural racism, the founder of criminology, according to the etiological paradigm, meets patriarchalism in the space of non-being called the Judicial Asylum. In this context, to what extent can the Office of the Public Defender be a megaphone of the polyphonic fights for dignity of the crazy criminals interned in the Judicial Asylum of Rio de Janeiro?


Bio notes

Patrícia Magno is a Public Defender of the Public Defender Office of the State of Rio de Janeiro working in the Penitentiary System Unit. She is a researcher linked to the Human Rights Laboratory of the Federal University of Rio de Janeiro (LADIH / UFRJ) and to the Research Group Critical Theory of Human Rights (CNPQ). She’s taking her doctorate in human rights from the Federal University of Rio de Janeiro, Brazil and currently, as a doctoral student visitor at the Centre for Social Studies of the University of Coimbra, Portugal.

Silvia Rodríguez Maeso had her PhD in Political Sociology (University of the Basque Country). She lectures in the PhD Programmes: "Democracy in the 21st Century" (FEUC/CES) and "Human Rights in Contemporary Societies" (CES/IIIUC). She is currently coordinating the research projects: COMBAT - "Combating racism in Portugal: an analysis of public policies and anti­discrimination law" (FCT, 2016-2019); and POLITICS - "The politics of anti-racism in Europe and Latin America: knowledge production, decision-making and collective struggles" (ERC, 2017-2022). Silvia has developed her research interests and teaching activity in postgraduate courses in the areas of critical theories of race and (anti-)racism and decolonial thinking with a focus on the analysis of the relation between power and knowledge production, public policies and socio-legal discourse.

Tiago Ribeiro had his Bachelor (2006) and master (2014) degree in Sociology (Faculty of Economics, University of Coimbra).  He is Junior researcher at the Centre for Social Studies and invited lecturer (part-time) at the School of Education and Social Sciences of the Polytechnic Institute of Leiria (since 2009). PhD candidate in Sociology, with a research project focused on the normative invocation of sexuality.
