Social rights: legislative and judiciary capacities

Abstract
The competence of the infra constitutional legislator, in relation to social rights, is broad, or,at least, defies the constitutional limits and also budget legislation. However, the judiciary compacity is, of course, more limited. It follows that the legislature can give conformation more generally and expressively to social fundamental rights in its implementation while the judiciary should be more restrained in its execution.

This seminar intends to put into question these d base distinctions that are considered extremely important in the context of a constitutional and democratic regime in which institutions and powers, in particular, have their roles defined by the constitutional system.

Each of the parties will make an initial intervention of 20 minutes, followed by a Q&A between them and the public
