Presentation

The Advanced Training Program Justice XXI, proposed by the Trade Union Association of Portuguese Judges (ASJP) and by the Centre for Social Studies/Permanent Observatory for Portuguese Justice of University of Coimbra, presents the 2nd course in 2010, dedicated to “Intellectual Property Rights: new social-economic and legal challenges”.

The law 16/200 of 1/04 has performed the transposition of Directive 2004/48/EC, named Enforcement Directive, to national law, considering that the existence of an Internal Market requires the implementation of restrictions to free circulation and distortions of competition, aiming at the creation of a favourable framework to innovation and investment.

The protection of Intellectual Property is essential to the promotion of innovation and creation, to the development of employment and reinforcement of competition, as well as to the protection of Fundamental Rights. Thus, the existence of effective means to enforce the respect for Intellectual Property rights has a vital importance to the success of the Internal Market.

This course is organized in order to present a wide perspective on Intellectual Property Rights, as well as to provide an analysis of the social-economic and legal challenges posed by these rights, and corresponding protection resources, to market and Law agents.
